An exotic dancer has filed a lawsuit in District Court against The Kitchen, LLC, owner of Las Vegas Strip Club near Interstate 15 and West Harmon Avenue, alleging the club failed to protect her from a patron who repeatedly exposed himself and assaulted her. The complaint, filed Monday by attorney for Mayisel Martinez, accuses the club of negligence, negligent hiring and supervision, and intentional infliction of emotional distress. It also names patron Jesse Tamez of Texas, accusing him of assault, battery and intentional infliction of emotional distress.
According to the lawsuit, Martinez was performing a 30-minute private dance in the champagne room on March 23, 2025, when Tamez exposed himself and began masturbating. After she admonished him and he apologized, she agreed to continue, but Tamez then allegedly grabbed and kissed her aggressively and exposed himself again. Martinez said she informed security, but Tamez was allowed to remain in the room and a manager told her to complete the prepaid dance.
The complaint alleges that despite Tamez's assurances he would behave, he disrobed and touched himself again once the dance resumed. The lawsuit claims the club breached its duty by failing to train security to respond to sexual assault reports, lacking safety protocols such as panic buttons or monitoring in the champagne room, and failing to remove the patron after the initial report. It says security merely warned Tamez and returned Martinez to the dance.
Metropolitan Police Department officers arrested Tamez, who was initially charged with gross lewdness and indecent exposure. Justice Court records show he pleaded no contest to engaging in lewd conduct in a public place and received a 120-day suspended jail sentence, a one-year stay-out-of-trouble order, a no-contact order with Martinez, a stay-away order from the club, and a requirement to undergo impulse control counseling. The lawsuit seeks damages exceeding $15,000 for each of its six claims. The club did not respond to a request for comment.
