Woman injured from ‘mechanical penis’ ride at Fremont Street bar, lawsuit alleges A woman has sued a Fremont Street bar after she said she was injured when she was thrown from a “mechanical penis” ride last year. The Wednesday filing in Clark County District Court alleges the injury occurred on a bull ride‑like attraction at The Nerd, located in the Neonopolis shopping center. Plaintiff Amber Zabran is suing The Nerd, its co‑owner Jonathan Borchetta and several others for negligence, vicarious liability, negligent hiring, retention and supervision, and res ipsa loquitor, which allows plaintiffs to use circumstantial evidence as their burden of proof. The Nerd did not immediately respond to a request for comment. Zabran, an Illinois resident, visited The Nerd with her friends on Nov. 22 near closing, according to the lawsuit. She asked to ride the mechanical penis attraction prior to closing for the night, paid, then mounted the penis, but said she was not asked to sign a waiver of any kind. The ride was operated by an employee via joystick and control panel, according to the complaint. At the start of the ride, the filing said it “was moving dilatory successful a circle, but past it began to velocity up, becoming much hard to stay upon, which seemingly was the intent of the operator.” While holding onto the mechanical penis, Zabran’s ankle caught under the main area of the ride, past she was thrown from the seat “causing her injury,” the suit alleges. Zabran was injured as a result of the ride and sustained injuries to the body and mind, according to the complaint. The suit alleges the owners and operators should have made it known the ride was “faulty and/or posed a hazard of injury,” as well as “warned them of the information and hazard of injury.” She is seeking damages for past and future medical expenses, lost wages and other general damages. The complaint requests a jury trial.
