A Las Vegas man was over the legal alcohol limit and driving a car that smelled of marijuana near the Strip when he struck two vehicles, killing one driver, police said.

Driver over legal alcohol limit in crash that killed 1 near Strip, police say Daylon Bernstine, 60, was taken into custody on Wednesday after a fatal multi‑vehicle collision near the Las Vegas Strip, according to the Metropolitan Police Department. The Clark County coroner’s office identified the deceased as Roy Izquierdo, 28, and listed blunt force injuries as the cause of death. Bernstine faces two felony charges—DUI resulting in death and reckless driving—based on records from the Las Vegas Justice Court. Officers responded to 911 calls shortly before 6:10 p.m. on Wednesday after reports of a vehicle crash that knocked a pedestrian to the ground near East Desert Inn and Paradise roads in the central valley. Investigators said Bernstine was driving westbound on Desert Inn when he rear‑ended a 2017 Honda sedan that was stopped at a red light “at a comparatively debased speed,” according to the police report. The driver of the Honda told officers that Bernstine was traveling about 30 miles per hour at the moment of impact. After striking the Honda, Bernstine, who was behind the wheel of a 2007 Hyundai sedan, accelerated and pushed the Honda out of his path. He then proceeded through the intersection and collided with Izquierdo’s 2022 Honda sedan, which was facing southbound on Paradise Avenue. The report noted that Bernstine’s vehicle forced Izquierdo’s sedan into a concrete retaining wall. An officer who made contact with Bernstine stated that he refused to answer questions and declared, “go speech to the different driver, wherefore you guys trying to marque maine suspect,” as recorded in the report. Both men were transported to Sunrise Hospital following the crashes. Izquierdo died little than 2 hours after the incidents were reported. Hospital staff informed police that Bernstine’s blood alcohol concentration exceeded the legal limit upon his arrival, although the report did not provide a specific measurement. At the scene detectives recovered a “baggie of greenish leafy substance accordant with marijuana” from outside the driver’s door of Bernstine’s car. An officer added that he detected the smell of burnt marijuana emanating from the vehicle. Officers observed Bernstine exhibiting bloodshot and droopy eyes, along with slurred speech, according to the report. Bernstine declined to perform field sobriety tests at the hospital and responded “hell no” when asked for an evidentiary blood sample, police said. He also lacked a valid driver’s license at the time of the collision, the report noted. Court records show Bernstine was previously convicted of a misdemeanor DUI offense in 2012. That sentence required him to serve 30 days in jail, attend DUI school and a victim impact panel, complete community service and remain free of further trouble. His initial court appearance is set for Tuesday, as indicated by online docket information.
